You are not importing a boat. It is U.S. built. As others have said. It is easier to buy the boat in Canada and bring it across yourself.

The only issue is documentation. I bought a U.S. built boat that was registered in the Cayman Islands for tax purposes. The only issue was getting a documentation service to get us clear title in the U.S.

Actually, he imports the boat and you buy it.

Go to Kingston Ontario, buy the boat and sail it to Oswego and import it on your own. It is only a 2 hour drive from Oswego.

My guess is the Seller is trying to avoid some kind of Canadian Sales Tax, by selling boat in US

I can't think of any such Canadian tax on the seller. Would there be some advantage to the US buyer... other than free delivery?

Free? It's negotiated into the purchase price.

Seller doesn't pay the taxes, the buyer does . Sounds like the buyer is trying to avoid the GST (13%) of the lower NY sales tax (8.75%)

Free? It's negotiated into the purchase price.
That ain't gonna happen either, you gotta show that you paid your taxes, either way on a private sale the seller doesn;t submit the taxes, the buyer does. Now if they went through a broker, the broker would submit the taxes after collecting from the buyer as part of the sale. Now if he was leaving immediately then he could get an exemption on the taxes as long as he can show its paid somewhere else.

It is normally against the law to sell a foreign vessel in US waters. It can be done but it's going to cost you and this is probably why you were told to deal through a customs broker who knows how to work around that law. You will open a can of worms you don't want to deal with.

Complete the sale in Canada. Bring it across to the US declare your purchase pay your tax..... done ! Incredibly simple to do it this way.

As a US buyer you will not be licensing/registering (that's when Canadian sales taxes are due) the boat in Canada so there will be no taxes due to either buyer or seller in Canada.

Sharon and I have delivered hundreds of boats across the border over the last 30 years it's very simple.
