Boat bill of sale?

Can anyone tell me where to download a bill of sale form for a boat that includes a clause for pending successful sea-trial and survey?

thanks!

http://www.oceanmarinellc.com/broker...eAgreement.pdf You can write anything additionally desired under additional provisions clause such as sea-trial, inventory, repairs, etc.

That form is for Yacht Brokers (Yacht Sales Professionals who are members of the Yacht Brokers' Association of America (YBAA)), by the way. You may also want to note it is outdated, stating it is valid in 2004. Just an observation.

Re: Boat bill of sale?

Ok, the more I look at that bill of sale the more I think it won't work for what I'm trying to do. The sale of the boat I was buying fell thru a couple months ago, but I am looking again. What I really need is a simple bill of sale between individuals that prevents the seller from selling to another buyer while I'm waiting for the boat to be surveyed.

Any help would be greatly appreciated.

Re: Boat bill of sale?

I don't know the OP's reason for saying the Yacht Broker's Sale Agreement won't work for him, but as to the other one linked to a couple of immediate issues I see. First, the lack of dates. It doesn't say how long the buyer has to either complete the deal or reject it. So it's an open ended agreement.

In addition it says nothing about any representations made. Nothing about warranty or lack thereof. Nothing about what seller is to do with the deposit while waiting for the survey. It also says nothing about the execution of the survey, the haul out, etc. Nothing about who assumes risk in the event of accident during the survey or interim period.

The missing items could certainly be added to it.

On the other hand the Yacht Broker's form obviously assumes a broker is involved, but those sections could easily be struck through. Personally, I would take that form as a starting point and then modify to meet the circumstances.

Re: Boat bill of sale?

Your really talking about two different documents. One is a contract to purchase the vessel, Purchase Agreement, and you can make any changes or additions you like. All brokers use the same basic contract with a few personalized additions. The other is the Bill Of Sale is to be used at the closing of the sale to show the transfer of ownership. You might ask for some professional help. Chuck

Re: Boat bill of sale?

Hey, thanks. Put contract to purchase a vessel in google and got what I needed. The boats I'm looking at are too inexpensive for most brokers to mess with, otherwise I would work with a broker for sure.

Re: Boat bill of sale?

Let me get my mind wrapped around what you just said. Your buying boats too expensive to be sold by brokers using a purchase agreement you downloaded online. OK, you got us. As a former broker, there is no such thing as a yacht too expensive for a broker to handle. Chuck

Re: Boat bill of sale?

The OP said too "inexpensive", not too "expensive".

Hey Chuck,

I've done stuff like that before, no worries. Honestly when I first read your post I figured that I had mistyped my post. Had a broker tell me over the phone that he would not mess with a $4,000 boat, said others wouldn't either. If there are any brokers in the LA area that will I would love to do business with you.

Re: Boat bill of sale?

Thanks Doug. As a former broker, I would sell boats at any price if they were worth it. I stayed away from fixer uppers and project boats. But your right, you probably won't find one to handle anything in that price range. It isn't worth it to them. Good luck and if I can offer any advise, don't hesitate to ask. Chuck

Most brokers wouldn't and it's not because of the small commission but because of two things. First the low likelihood of a happy satisfied buyer. Second, Craigslist has become the home of those boat sales.
