Lagoon Bulkhead issues during purchase

Hi all, looking for some advice from any and all.


Here are the givens: The model of Lagoons I am looking at have bulkhead issues that are known and warrantied (or at least that is what I am told) by Lagoon (a few threads about it here).


Let say you are about to get a Survey and you are aware the boat has NOT had the warrantied work done (takes a bit of scheduling which can be difficult with Lagoon and about 10-15 days from what I am told).


Lets say that you are interested in securing a contract to buy the boat.

Surveying before the work is done seems to be a waste of money and time.



What are the options?


1) Buy the boat and then deal with Lagoon to warranty the fix? (least desirable)
2) Somehow get the seller to sign some sort of first right of refusal agreement that would allow you to buy the boast at agreed upon purchase price AFTER the work has been performed? (most desirable, but no clue how to accomplish)

3) Ask seller to get wok done and wait till finished and then survey and hope for no new offers in the interim (not desirable)
4) Get survey done with offer pending and then have seller get work done in order for sale to go through (seems like a gamble, but have seen it happen).
5) any and all other ideas....)

Which model Lagoon?

Are you sure it is still under warranty? I believe the hull warranty for Lagoon is 5 years, so if the hull is older than 5 years I wouldn't count on the builder to make the repairs.

Go with #2 - a contingency contact for this and any other work the surveyor says is needed. Anything else is too risky. The contract should call for the repaired work to be inspected by Your own surveyor and be done to your satisfaction.

Be sure you have your own broker or lawyer representing you and drawing up the language. This is not an unreasonable request if you’re looking at an issue that would otherwise kill the sale. It is also fairly routine.

IMO the present owner should get it fixed. It could only help sell the boat. Buyers aren't going to be keen on having an issue like this hanging over the boat.

What model Lagoon are you referring to and what year?



There are structural bulkheads which are reinforced with heavy duty fiberglass and then there are the floor and wall supports which look like bulkheads but are only glued in. The glue can crack when the boat flexes over time, but it is unlikely to compromise the hull structure at all. If you get a survey done, get it done by a surveyor who has done plenty of catamarans.
