Did you follow the link? This is a registry of approved "works" under the Act. If this is not how yours got approved, can you send the link to the application form? I'm just trying to understand how this happens, I'm not challenging you, or anything.

BTW, it is a basic requirement that NO moorings can obstruct navigation. No mooring would be allowed, and that is definitely grounds for removal and fining.

I asked the Coast Guard, they supplied a form, I filled it out and supplied the extra materials, waited, it was approved.....

Got to say I'm surprised - pleasantly so. Would be nice to think there is actually a government service/agency that actually makes it easy to access their services. This might actually make a dent in some of the "scrap" piling up on the beaches - the hell with straws :-)

Why not just post up the type of boat, and show where it is on a map, and maybe one day it will miraculously vanish, never to be seen again. After a year, it is obviously abandoned, so may as well see if someone else wants it.

I've looked and looked, and I can't find anything under CCG. I keep circling back to the Transport Canada Acts and regs, which are as I posted.

There are regs around buoy shape, colour and size, which the CCG does enforce, but the authority still comes through TC.

I'm really not trying to be difficult here, but I just can't find what you're refering to nwdiver, and it doesn't jibe with the laws and regs that I can find.

Here is a document from a BC Natural Resources ministry titled: Mooring Buoy FAQ’s

Under FAQ#3 it states:

The Owner’s Guide to Private Buoys has been published by Transport Canada to illustrate the standards for markings.
It does go on to state there may be certain circumstances where permits are required, but this appears to be the exception, not the rule.

Another areas of NRS states: "Placement of a mooring buoy is subject to review and approval" (bold is mine), but it does not explain how it is reviewed or approved.

I'm more confused than ever...

“The Private Buoy Regulations, established pursuant to the Canada Shipping Act, prescribe the mandatory marking, lighting, size, and placement requirements for mooring buoys. Under the Navigation Protection Act, buoys are a “work” and may require authorization from Transport Canada. The only buoys that do not require authorization before being placed are those that are built or placed in accordance with the criteria listed in the Minor Works Order, under the class of works called “Mooring Systems”.

Just to resurrect this thread, Pacific Yachting did a great pice on the complexities of the law in Canada

Thanks Mac. Great read. Lays things out well. Reinforces my view that anyone who lays a personal moor should do so in a way that doesn't interfere with normal anchoring. Place it tight into shore, or on the outer edge of an anchorage.

Too often, these damnable things are placed right in the middle of an anchorage, thereby blocking everyone else's use. It's tantamount to someone blocking a parking place on a public road. I wish the authorities would act on complaints and remove ones like that.

Anyone can trace ownership of a Registered Vessel on line. The privacy issue has not caught up to this area ... yet.
License ownership data is only available to police and SAR.
