More incorrect information, the forms supplied will all be needed to register your recreational vessel with AMSA should anyone decide to do so. As with most of the forms from AMSA they have dual or more uses, you just need to fill out what is applicable to yourself.

The only ones that you will have to choose from are AMSA forms 211 & 222, for very obvious reasons you will only need to fill out one or the other.

Again i reiterate, if you want to know the correct requirements go to the relevant department and ask/read and research....

EDIT: I am in no way telling individuals what they should and shouldn't do, i couldn't give a rats about it, i just wish people would quit posting BS info for the uninformed to follow, do the research people it ain't that hard...

Are you suggesting that Australian owners do not register their EU based yachts in countries other than Australia? Are you suggesting this is not common practice? Are you suggesting anyone has ever gotten into trouble for doing so? Are you suggesting people who state they have done so are posting BS? How exactly do you define BS?

I never suggested any of the above, and you selectively omitted 'I am in no way telling individuals what they should and shouldn't do, i couldn't give a rats about it'
The BS in this case was in reference to the post i quoted, and the rest is in reference to individuals who post on a public forum that what they do, or have done, and claim it's all ok, when in actuality they should be advising what is (legally) required and then what they have done, that way the individual asking gets the full picture and can make a informed decision on which way they want to go from there......

Just saying 'this is what i/we did' is only half an answer and could easily end up dropping someone right in it, whats hard to understand about that?

Agreed, but others have, and you state you wish others (presumably those with opposing views to yours) would stop posting BS - what's hard to understand about that?

What opposing views? the only things I have posted is opposing facts backed up with links to that data, not my views, and if that offends some then I suggest a steady diet of cement and reality is needed

Referring to other posts as BS may cause offence. Best avoided.

Re: Aussie owner Italian flag

Hi all,
Am also looking at purchasing an Italian flagged vessel with VAT paid. Am I correct in expecting a VAT refund because I am "exporting" the vessel from the EU, but will then be up for GST and Import Duty (15% all up I believe) when I get her to Oz?

Only if you buy from a dealer where the dealer 'declares' VAT on the purchasing price (normally only happens if you buy new) or if you buy from a company.

Carsten

You are not paying any VAT if the boat is already VAT paid and there is nothing to refund. You can't get a VAT refund when you never paid VAT.

As Carsten says it will normally only apply if you're buying new from a dealer.

The other time that it can happen is if you were to buy an ex-charter yacht direct from a charter company.

Thanks, so the owner who has paid the VAT, can' get a refund if he then "exports" the boat to an overseas buyer?

Gee, that is crap … especially when an os buyer will have to pay vat/gst on the value in the destination country.

The only time that could happen would be if the original owner was a VAT registered company (for example a yacht charter company that owned it's own yachts).

Although, the company wouldn't get a "refund" in that case it's just that you wouldn't have to pay the VAT.
