I wonder how they moved boats around in the old days before licenses?
For me...it is not the license but the person I focus on.
Seen too many idiots flashing their license around that are clueless

Here in the U.S its not that tough?

Guy, either you are delusional or argumentative. There is nothing to stop ANYONE accepting your check for damage, cashing it and still going to the insurance company.........and it will be your fault for trusting them. The world is a different world to Dagwood these days...

Im glad your not letting the facts stand in the way of your prejudice. Seems like people can tell you something, but they cant tell you much.
Ah, I see.

You've watched others do it, but have never done it yourself. There's a parable about blind men and an elephant who do exactly the same thing.

I have exactly the same protection the insurance companies have. In fact, I stole most of it from them. (Plagerized being a fancy name for theft.)

P.S. I've forgotten what your point is, beyond general angst, posing and fear.

As Winston Churchill said:
  • The truth is incontrovertible, malice may attack it, ignorance may deride it, but in the end; there it is.

I think we are done here.

Pee Wee Herman said "I'm the luckiest boy in the world!"

Both sources (and quotes) are equally relevant.

Re: Captain Damaged Neighboring Boat- Who is Responsible?

My Morgan36 worth $20K USD hit another boat earlier this year while trying to dock at my marina in 20knt winds plus some current. I had 2 experienced crew members on board, I only have one year big boat sailing experience. Just testing the boat in the Atlantic in 6foot seas and 20knts wind. This test went well.

When trying to dock the wind/current caught the boat from the side with the swing keel up it drifted 20 feet back into the other boat. Hit the nearby boat, scrapped the paint in one stern corner, ~$400 to repair and equivalent to a months docking fee.
This seems like a low cost to learn under what conditions to take the boat out and back.

Don't even think about filing an insurance claim unless you want to get a quick raise in your rates due to the hurricane. You should feel very lucky you only had $1,500 worth of damage and move on !

Re: Captain Damaged Neighboring Boat- Who is Responsible?

I can't say I'd be happy about it but I'd just pay the $1500 for the other boats repairs and then I'd approach the delivery skipper and ask him how much of that he felt should be his responsibility and his answer to that question would determine what I gave him for a recommendation to every other boater in the area that I knew. But if he didn't want to contribute to paying for the damage his carelessness caused, I wouldn't bother suing him. By the time I gathered all the facts and hired a lawyer and wasted time showing up in court I'd have probably paid out more than $1500 and unnecessarily missed out on several days enjoying my boat.

I would think he owes the other owner the money and the damaged owner owes the Marina for the repairs.

As for the insurance, my hull coverage has a deductable, but I don't think I've ever seen a deductable on my liability coverage. I've had a lot of different insurances over the years and don't remember ever having a deductable on my liability coverage. Can I be saving money by having a deductable on my liability as well as my hull coverage? I would think that this would be covered under the OP's liability policy.
The op obviously received the bill from the marina as a result of being legally bound by the CONTRACT he signed with the marina requiring he assume all responsibility for any damage caused by his vessel. If he had a contract with the delivery captain of a similar nature he still would have to pay for the damage as required by the contract with the marina and would then have to go to the delivery captain for reimbursement under the terms of the delivery contract. If he had no contract with the captain then generally speaking if it's not in writing it never happened. Verbal contracts hold little weight in court unless.there was a witness it all becomes heresay which is inadmissible in court. CYA.

Oh well , still monitoring a four year old thread? They show up in my emails like they are current threads. The dates are small on a smartphone.
Thanks for the heads up.
